These Terms of Service (“Terms”) govern your access to and use of SummerPrograms.com and its related pages, features, forms, communications, and services collectively, the “Services”).

The Services are operated by SummerPrograms.com (“SummerPrograms.com,” “we,” “us,” or “our”).

Please read these Terms carefully. By accessing or using the Services, submitting an inquiry, submitting or managing a listing, purchasing a listing or promotional service, or otherwise interacting with SummerPrograms.com, you agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, do not access or use the Services.

1. About SummerPrograms.com

SummerPrograms.com is an online directory and information platform that helps students, parents, guardians, educators, and other users discover summer camps, academic programs, enrichment opportunities, travel programs, employment opportunities, and other educational or recreational experiences.

The website contains a combination of:

Free program listings;
Paid or enhanced listings;
Featured placements;
Sponsored content;
Advertisements;
Information gathered from publicly available sources; and
Information submitted by independent program providers.

Unless we expressly state otherwise, SummerPrograms.com does not own, operate, manage, supervise, inspect, license, accredit, or control the programs or organizations listed through the Services.

Program providers are independent third parties and are solely responsible for their programs, personnel, facilities, policies, representations, admissions decisions, safety practices, pricing, availability, and services.

2. Eligibility and Use by Minors

The Services and our inquiry forms are intended to be used by:

Parents and legal guardians;
Adult students;
Educators and counselors;
Program representatives;
Employers; and
Other individuals who are at least 13 years old.

Children under 13 may not independently submit inquiries, subscribe to communications, create an account, or otherwise provide personal information through the Services.

A parent or legal guardian must use the Services and submit inquiries on behalf of a child under 13.

By using the Services, you represent that you are legally capable of agreeing to these Terms. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Directory and Information Service Only

SummerPrograms.com is a directory, advertising, referral, and information service.

We are not a party to any relationship, contract, application, enrollment, employment arrangement, payment, transaction, dispute, or other interaction between a user and a program provider.

Submitting an inquiry through SummerPrograms.com does not constitute:

An application;
An enrollment;
A reservation;
An offer of admission;
An acceptance into a program;
An employment application unless expressly stated;
A guarantee of availability;
A guarantee of eligibility; or
A guarantee that a provider will respond.

Any application, enrollment, contract, payment, refund, cancellation, employment arrangement, or other transaction must be completed directly with the applicable program provider.

4. No Endorsement, Verification, or Guarantee

A program’s appearance on SummerPrograms.com does not constitute an endorsement, recommendation, accreditation, certification, approval, investigation, or guarantee by SummerPrograms.com.

Paid listings, featured placements, sponsored content, and advertisements may receive greater visibility than free listings. Payment for placement does not mean that SummerPrograms.com has independently evaluated or approved the provider or program.

Unless expressly stated in writing, we do not:

Conduct background checks on providers or their employees;
Inspect program facilities;
Verify licenses, permits, insurance, accreditation, or certifications;
Review staff qualifications;
Confirm health or safety procedures;
Confirm accessibility or accommodation claims;
Verify program pricing, dates, availability, or eligibility;
Evaluate transportation, lodging, supervision, or security arrangements; or
Guarantee the accuracy of provider-submitted information.

Any verification badge, featured designation, or similar label indicates only the specific criteria expressly described on the website. It does not constitute a general endorsement or guarantee of quality, safety, suitability, or performance.

5. User Responsibility and Independent Evaluation

You are responsible for independently researching and evaluating any program, provider, employer, or opportunity before applying, enrolling, accepting employment, making a payment, traveling, or providing sensitive personal information.

Before making a decision, users should consider contacting a provider directly and reviewing matters such as:

Program dates and availability;
Total costs and payment terms;
Cancellation and refund policies;
Licensing and accreditation;
Insurance coverage;
Staff qualifications and background checks;
Supervision ratios;
Health and safety procedures;
Transportation and lodging;
Emergency plans;
Accessibility and accommodations;
Required forms and medical information;
References and reviews; and
The provider’s privacy policy and terms.

SummerPrograms.com does not provide legal, medical, educational, financial, travel, safety, employment, or other professional advice.

You assume responsibility for decisions made based on information obtained through the Services.

6. Program Inquiries and Lead Delivery

The Services may allow you to request information from an independent program provider.

When you submit an inquiry about a program or organization, you direct and authorize SummerPrograms.com to provide the information contained in the inquiry to that provider.

Inquiry information may be:

Processed through our form-processing service;
Automatically emailed to the applicable provider; and
Stored in a private online document shared only with that provider through an authorized provider email address.

Each provider is given access only to inquiries related to its own organization or programs. Providers do not have access to inquiries submitted to unrelated providers.

A provider may use inquiry information to:

Respond to the inquiry;
Provide program information;
Contact the person who submitted the inquiry by email or telephone;
Discuss dates, pricing, availability, eligibility, or enrollment; and
Follow up regarding expressed interest in the provider’s programs.

Providers may maintain their own copies of inquiry information. Once information has been delivered to a provider, that provider’s handling of the information is governed by its own privacy policy and practices.

SummerPrograms.com does not control and is not responsible for the timing, frequency, content, accuracy, or nature of a provider’s response or subsequent communications.

Submitting an inquiry does not authorize marketing text messages from SummerPrograms.com. Providers are responsible for obtaining any legally required consent before sending text messages or making marketing calls.

7. User Information and Inquiries

When submitting information through the Services, you agree to:

Provide accurate and current information;
Use an email address and telephone number that you are authorized to provide;
Submit inquiries only for legitimate personal, family, educational, or professional purposes;
Avoid impersonating another person;
Avoid submitting false, fraudulent, harassing, or misleading inquiries;
Avoid submitting sensitive information unless specifically requested and reasonably necessary; and
Avoid using inquiry forms to advertise, solicit, spam, or contact providers for unrelated purposes.

You may not use another person’s personal information without authorization.

We may block, remove, or decline to transmit inquiries that we reasonably believe are fraudulent, automated, abusive, misleading, unlawful, or unrelated to the purpose of the Services.

8. Provider Listings and Representations

A “Provider” means any camp, school, college, university, organization, employer, business, individual, or other entity that submits, claims, maintains, advertises, or promotes a listing through the Services.

Providers are solely responsible for all information, images, materials, claims, and content associated with their listings.

By submitting, claiming, approving, or maintaining a listing, a Provider represents and warrants that:

It is authorized to represent the listed organization;
The information provided is accurate, current, and not misleading;
It has all licenses, permits, approvals, insurance, and authorizations required for its operations;
Its program descriptions, prices, dates, eligibility requirements, and availability are accurate;
It will promptly inform us of material changes;
It has the rights and permissions necessary to provide all submitted text, photographs, logos, videos, and other materials;
Its content does not infringe intellectual-property, privacy, publicity, or other rights;
Its advertising claims are truthful and reasonably supported;
It will comply with applicable privacy, consumer-protection, advertising, employment, accessibility, and communications laws;
It will not misrepresent its affiliations, accreditation, certifications, safety practices, or qualifications; and
It will not submit unlawful, discriminatory, defamatory, fraudulent, or deceptive material.

Providers must promptly request corrections when a listing becomes inaccurate, incomplete, expired, or misleading.

9. Provider Use of Leads

Providers may use inquiry information only for legitimate communications related to the program, service, employment opportunity, or organization about which the user requested information.

Providers must:

Limit access to authorized representatives who need the information;
Maintain reasonable administrative and technical safeguards;
Protect inquiry information from unauthorized access or disclosure;
Avoid publishing, selling, renting, or distributing inquiry information;
Avoid using inquiry information for unrelated solicitations;
Honor applicable unsubscribe and communication requests;
Comply with privacy and communications laws;
Avoid sending text messages without any legally required consent; and
Delete or securely dispose of information when it is no longer reasonably needed.

A Provider may not use leads obtained through SummerPrograms.com to create or enhance a list for resale, data brokerage, unrelated advertising, or distribution to third parties.

We may restrict, suspend, or terminate a Provider’s access if we reasonably believe that leads have been misused, inadequately protected, or accessed by unauthorized individuals.

10. Free, Paid, Featured, and Sponsored Listings

SummerPrograms.com may offer free listings, paid listings, featured placements, sponsored content, enhanced profiles, lead-generation services, advertising, or other promotional services.

The availability, placement, appearance, duration, features, and pricing of these services may vary.

Paid placement may affect:

Where a listing appears;
How prominently it is displayed;
Whether it receives a badge or enhanced design;
Which information or media can be included;
Whether the listing receives inquiry or performance reporting; and
Its visibility within particular categories, searches, or pages.

Unless expressly agreed in writing, purchasing a paid service does not guarantee:

A particular search position;
A particular amount of website traffic;
A specific number of views, clicks, inquiries, applications, enrollments, or sales;
Exclusivity within a category or location;
Admission or acceptance by users;
Continued availability of a particular feature or page layout; or
Any specific financial or business result.

We may identify paid placements, advertisements, or sponsored content using labels we consider appropriate.

11. Fees and Payment Terms

Certain Provider services may require payment.

The price, billing period, included features, and other applicable terms will be presented at the time of purchase, in an order form, invoice, proposal, email, provider agreement, or other written communication.

Unless otherwise stated:

Fees are quoted and payable in U.S. dollars;
Providers are responsible for applicable taxes;
Fees are due according to the applicable invoice or order terms;
Services may be suspended for nonpayment;
Fees already earned are nonrefundable; and
A Provider remains responsible for charges incurred before cancellation or termination.

If a service automatically renews, the renewal terms and available cancellation method will be disclosed at the time of purchase or in the applicable written agreement.

If these Terms conflict with a signed provider agreement, order form, or other written agreement between SummerPrograms.com and a Provider, the more specific written agreement will control with respect to that conflict.

12. Listing Placement, Modification, and Removal

We retain editorial and operational discretion regarding the Services.

We may, but are not required to:

Edit a listing for formatting, grammar, length, clarity, or consistency;
Select categories, tags, locations, or search filters;
Request documentation or verification;
Correct apparent errors;
Update publicly available information;
Decline or remove content;
Change the appearance or location of a listing;
Combine duplicate listings;
Mark a listing as inactive or outdated;
Suspend access to leads;
Reject advertising; or
Remove a provider or listing from the Services.

We may take these actions when we reasonably believe content is inaccurate, outdated, misleading, unlawful, inappropriate, harmful, infringing, technically problematic, or inconsistent with our standards or business interests.

We are not obligated to publish or continue publishing any listing, including a paid listing, except as expressly provided in a separate written agreement.

13. Publicly Available Listing Information

We may create or update listings using information obtained from publicly available sources.

A Provider that believes a listing is inaccurate or wishes to claim, update, or request removal of a listing may contact us at info@summerprograms.com.

We will evaluate correction and removal requests in good faith. We may request reasonable evidence that the person submitting the request is authorized to represent the organization.

14. Submitted Content and License

“Submitted Content” means text, descriptions, logos, photographs, videos, graphics, documents, reviews, feedback, and other materials submitted or provided to SummerPrograms.com.

You retain any ownership rights you have in Submitted Content.

By providing Submitted Content, you grant SummerPrograms.com a nonexclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, format, edit, adapt, publish, display, distribute, and otherwise use the Submitted Content as reasonably necessary to:

Operate and promote the Services;
Display and market the applicable listing or organization;
Create website pages, category pages, emails, and social-media content;
Format content for different devices and platforms;
Advertise SummerPrograms.com and its listed opportunities; and
Perform services requested by the submitting party.

This license continues for as long as the content is used through the Services and for a reasonable period afterward for backups, archives, legal compliance, and materials already produced or distributed.

You represent that you have all rights and permissions needed to grant this license.

15. Intellectual Property

The Services and their original content, design, organization, compilation, databases, software, graphics, logos, trademarks, page layouts, and other materials are owned by or licensed to SummerPrograms.com and are protected by applicable intellectual-property laws.

Except as expressly permitted, you may not:

Copy or reproduce substantial portions of the Services;
Republish or distribute our content;
Create a competing database or directory from our content;
Use our branding without permission;
Remove copyright, trademark, or proprietary notices;
Sell, license, or commercially exploit our content;
Frame or mirror the Services; or
Use automated systems to extract or reproduce listings, leads, or other data.

You may use the Services for ordinary personal research and legitimate internal business purposes consistent with these Terms.

“SummerPrograms.com” and associated logos, designs, and branding are trademarks or service marks of SummerPrograms.com or their respective owners.

16. Copyright and Intellectual-Property Complaints

We respect intellectual-property rights.

A person who believes that content on the Services infringes a copyright, trademark, or other proprietary right may contact us at info@summerprograms.com.

The notice should include:

Identification of the protected work or right;
Identification and location of the disputed material;
The complaining party’s name and contact information;
A description of the basis for the complaint;
A statement that the complaint is made in good faith; and
Documentation showing ownership or authorization, where reasonably available.

We may remove or restrict access to disputed content while reviewing a complaint.

17. Acceptable Use

Accuracy;
Availability;
Security;
Privacy practices;
Terms;
Products;
Programs;
Employment opportunities;
Representations;
Payments;
Refunds; or
Transactions.

Links are provided for convenience and informational purposes. A link does not imply endorsement or approval.

Your interactions with third parties are solely between you and the third party. You should review the third party’s terms, privacy policy, cancellation policy, and other applicable information before providing personal information or completing a transaction.

19. Corrections and Availability

Information on the Services may contain errors, omissions, outdated details, formatting issues, or inaccuracies.

Program dates, prices, availability, staffing, locations, eligibility requirements, and other details can change without notice.

We may correct or update information at any time, but we do not undertake a general obligation to independently verify or continuously update every listing.

We do not guarantee that the Services or any particular listing, page, form, feature, or communication method will always be available.

We may modify, suspend, discontinue, restrict, or replace any part of the Services at any time.

20. Privacy

Our collection, use, and disclosure of personal information are described in our Privacy Policy.

By using the Services, you acknowledge that information will be handled as described in that policy.

Providers receiving inquiry information act independently with respect to their subsequent use of that information and must comply with their own legal obligations.

21. Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis.

SummerPrograms.com disclaims all warranties and representations, express or implied, including warranties of:

Accuracy;
Completeness;
Currency;
Availability;
Reliability;
Security;
Merchantability;
Fitness for a particular purpose;
Title;
Noninfringement; and
Any warranty arising from course of dealing or usage of trade.

We do not warrant that:

The Services will be uninterrupted, secure, or error-free;
Defects will be corrected;
Listings will be accurate or current;
Providers will respond to inquiries;
Any program will be safe, suitable, available, or satisfactory;
A user will be admitted to or benefit from a program;
A Provider will receive a particular number of leads or enrollments; or
The Services will meet a user’s or Provider’s expectations.

Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.

22. Limitation of Liability

To the fullest extent permitted by law, SummerPrograms.com and its owners, officers, employees, contractors, affiliates, agents, licensors, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including:

Lost profits or revenue;
Lost business opportunities;
Loss of data;
Reputational harm;
Travel expenses;
Program fees;
Replacement services;
Personal injury or property damage arising from a third-party program; or
Losses arising from reliance on a listing or communication.

This limitation applies whether the claim is based on contract, tort, negligence, strict liability, statute, or another legal theory, even if we have been advised that damages are possible.

SummerPrograms.com is not responsible for acts, omissions, statements, services, facilities, employees, contractors, participants, or policies of an independent program provider.

To the fullest extent permitted by law, SummerPrograms.com’s total aggregate liability arising out of or relating to the Services or these Terms will not exceed the greater of:

The amount you paid directly to SummerPrograms.com during the 12 months preceding the event giving rise to the claim; or
One hundred U.S. dollars.

The limitations in this section do not apply to liability that cannot lawfully be limited or excluded.

23. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless SummerPrograms.com and its owners, officers, employees, contractors, affiliates, agents, licensors, and service providers from claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

Your violation of these Terms;
Your use or misuse of the Services;
Information or content you submit;
Your violation of another person’s rights;
Your violation of applicable law; or
Your acts or omissions in connection with a program, inquiry, listing, or transaction.

A Provider’s indemnification obligations also include claims arising from:

Its programs or operations;
Its listing information or advertising claims;
Its employees, contractors, facilities, or participants;
Its handling or misuse of inquiry information;
Its communications with users;
Applications, enrollments, payments, refunds, injuries, or disputes; and
Alleged infringement caused by materials it provides.

We reserve the right to control the defense of a matter subject to indemnification. You agree to reasonably cooperate with that defense.

24. Suspension and Termination

We may restrict, suspend, or terminate access to all or part of the Services when we reasonably believe:

These Terms have been violated;
Information is false, outdated, misleading, or unlawful;
Payment is overdue;
Leads or personal information have been misused;
An account or document has been accessed without authorization;
Continued access creates legal, security, reputational, or operational risk; or
Suspension or termination is otherwise necessary to protect users, Providers, third parties, or SummerPrograms.com.

You may stop using the Services at any time.

Termination does not eliminate obligations or liabilities that arose before termination. Provisions that by their nature should survive termination will remain in effect, including provisions concerning intellectual property, fees, disclaimers, liability, indemnification, governing law, and dispute resolution.

25. Changes to the Services or Terms

We may modify the Services and these Terms periodically.

When we revise these Terms, we will update the “Last updated” date at the top of the page. We may provide additional notice when required by law or when changes are material.

Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms.

Changes will not retroactively alter any material payment obligation unless permitted by the applicable agreement and law.

26. Governing Law and Venue

These Terms and any dispute arising from or relating to the Services will be governed by the laws of the State of Arizona, without regard to its conflict-of-laws principles.

Subject to any applicable law that provides otherwise, the state and federal courts located in Maricopa County, Arizona will have exclusive jurisdiction over disputes arising from or relating to these Terms or the Services.

You and SummerPrograms.com consent to the personal jurisdiction and venue of those courts.

27. Severability

If a provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or modified to reflect its intended purpose as closely as possible.

The remaining provisions will continue in full force and effect.

28. No Waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce that provision or any other provision later.

A waiver is effective only if it is in writing and signed by an authorized representative of SummerPrograms.com.

29. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations in connection with a merger, acquisition, reorganization, sale of assets, change in control, or other business transaction.

30. Entire Agreement

These Terms, our Privacy Policy, and any applicable provider agreement, order form, invoice, proposal, or other written agreement constitute the entire agreement between you and SummerPrograms.com concerning the applicable Services.

They supersede prior or contemporaneous communications concerning the same subject matter.

If a specific written agreement conflicts with these Terms, the specific written agreement will control regarding the subject matter of that agreement.
